iGO Rewards Booking Terms & Conditions

Introduction

The iGO Rewards™ program (“Program”) is managed by Hutchison Travel Limited (“HTL” or “We”). We have engaged a number of providers to support certain elements of the Program infrastructure.

The Program is applicable to the principal cardholders (“Cardholder” or “You”) of the DBS Credit Cards and Co-branded Cards (excluding Private Label Cards and Business Cards) (each as "Applicable Credit Card", collectively "Applicable Credit Cards") issued by DBS Bank (Hong Kong) Limited (“DBS”). The Program is provided solely to assist Cardholders in gathering travel information, determining the availability of travel-related products and services, making legitimate reservations or otherwise transacting business with third-party travel suppliers (“Travel Suppliers”) of travel and travel-related products and services (“Travel Services”) such as airlines, hotels and ticketing consolidators, and for no other purposes.

HTL makes the Travel Services available to you solely in the capacity of agent for the Travel Suppliers.Hutchison Travel Limitedand the Travel Suppliers, together with their respective parent companies, subsidiaries, affiliates and suppliers, and their respective officers, directors, employees, representatives, agents and licensors, shall be referred to collectively herein as the "Covered Parties". By accessing and using the Program, you accept and agree to the following terms and conditions (“Terms and Conditions”) without limitation or qualification. If you do not agree with these Terms and Conditions, please do not use the Program.

These Terms and Conditions govern your use of the Program and your enquiries regarding, and purchase of any, Travel Services made available through the Program, and describe your responsibilities regarding such Travel Services. By using the Program and making enquiries regarding and/or purchasing Travel Services made available through the Program, you agree and warrant that:

  1. you will use the Program in accordance with the Terms and Conditions,
  2. you will only use the Program to make legitimate Travel Service reservations for you or for another person for whom you are legally authorized to act,
  3. you will inform such other persons about the Terms and Conditions that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto,
  4. all information supplied by you on the Program is true, accurate, current and complete,
  5. you acknowledge and consent to your personal information provided or used in connection with the Program being processed in accordance with our Privacy Policy; and
  6. you acknowledge and consent that your use of this iGO Rewards Program website is governed by our Website Terms of Use.

We retain the right at our sole discretion to deny access to anyone to the Program and the services we offer, at any time without notice and for any reason, including, but not limited to, for violation of these Terms and Conditions.

The Terms and Conditions (including fees, charges and other financial amounts) stated herein are subject to change.

If these Terms and Conditions are also provided in a language other than English, the English language version shall prevail in the event of any inconsistency

If you do not agree with any of the foregoing and/or it is not a truthful and accurate description of you, do not use the Program.

Booking Conditions

We reserve the right not to accept any booking request (including the right to cancel a confirmed booking) at our sole discretion without the need to provide any reason. In the event that a booking is rejected or cancelled by us and payment has already been received by us, we will refund the cash component of the booking to you without any further liability on us. DBS$ or COMPASS Dollar redemption cannot be amended or cancelled according to "DBS$ Reward Scheme Terms and Conditions" and "COMPASS CARD Reward Scheme Terms and Conditions" (full version can be downloaded at go.dbs.com/hk-reward-tnc) However, in iGO Rewards, the DBS$ or COMPASS Dollar component will be held on file as a credit (“Credit”). A Credit will be held for 12 months, from the date of cancellation, may only be used for one new Travel Service booking during that 12 month period, and is otherwise strictly non-refundable and non- extendable. Unless otherwise stated, all bookings made with us are also non-transferable to another traveler who is not stated in the booking. Please refer to the section titled Amendments & Cancellations for further details.

As we rely on the Travel Services provided by Travel Suppliers, we reserve the right to amend or cancel your booking at any time (i) if an error is made by the Travel Supplier, or (ii) in circumstances beyond our control (such as notification from the Travel Supplier that they are unable to provide the Travel Services, price variations, or discontinuation of and/or changes to promotions, airfares or specific travel products and/or services). In such circumstances, we may (i) vary your itinerary (such as substituting with alternative accommodation of a comparable or superior standard as the hotel booked, if necessary), with additional costs (if any) being borne by you, or (ii) cancel your booking or the relevant element of your booking.

Travel-Related Provisions

You agree that:

  1. You are responsible for any error in the accuracy of information that you provide in connection with the Program and any travel booking; and
  2. You are responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the Program. Charges from your use of the Program will appear in points and/or cash charges on the monthly credit card statements for your Applicable Credit Card associated with the Program, and
    1. Rates for flights include all taxes and service charges. A Booking Administration Fee will be added at time of payment (prior to your final confirmation). Airfare prices are not guaranteed until flights are ticketed. Additional charges, taxes, and fees may apply at the time of check-in and will be billed at that time directly to Cardholders. See c) below.
    2. Rates for hotels quoted before the checkout page include all taxes and service charges. A Booking Administration Fee will be added at time of payment (prior to your final confirmation). Additional charges, taxes, and fees may apply at the time of check-in and will be billed at that time directly to Cardholders. See c) below.
    3. Fees that may apply after the initial ticket purchase – including, but not limited to, (i) fees for itinerary changes or cancellations, (ii) after-purchase upgrades, including preferred or priority seat assignments, (iii) checked baggage fees, or (iv) in-flight food and beverage – are not included in the advertised rates and will be the responsibility of the Cardholder. Post-booking fees and charges vary and are determined by the Travel Supplier, and can vary by Travel Supplier.
  3. You agree to all terms and conditions of purchase imposed by  Hutchison Travel Limited and the other Covered Parties.
  4. Bookings and transactions require the use of an Applicable Credit Card.

All policies and procedures are subject to change at any time at our sole discretion without notice.

Travel Service prices shown are in DBS$ or COMPASS Dollar and Hong Kong Dollars based on rates in effect at the time of booking and are subject to change without notice.

Travel benefits may not be combinable with a Travel Supplier’s other offers.

Airline Tickets & Policies: All airline tickets are subject to the published contract of carriage and rules of the airline carrier on which you will travel. The contract of carriage in use by the applicable airline shall be between the applicable airline and the passenger only. The Covered Parties assume no responsibility in the determination and application of the terms and conditions applicable to the contract of carriage. A supplier that is an air carrier is required to make available to the public the terms of its contract of carriage, and we make available the fare rules for all air carrier tickets before booking.

The circumvention of an air carrier's rules, including practices such as back-to-back ticketing (booking two or more tickets with overlapping travel dates in order to circumvent minimum stay requirements) and hidden-city ticketing (booking tickets including segments which the booker does not intend to use in order to circumvent an air carrier's pricing structure), is prohibited by many air carriers. The use of prohibited ticketing practices may result in the air carrier taking actions including the cancellation of the ticket, denied boarding, revocation of frequent flier miles and other benefits, additional charges to the booker's credit card, additional charges collected at the airport, or future invoicing.

All flight details should be confirmed with the applicable airline carrier including, without limitation, the schedule of your flight, airline policies, checked baggage charges, checked and carry-on baggage size limitations or restrictions, and any other additional post-booking fees or charges that must be paid directly to the applicable airline. Airline schedules change frequently. Please reconfirm all flight dates and times with the appropriate airline 72 hours prior to departure. Airlines reserve the right to change aircraft equipment without notice to you or any passenger.

Hutchison Travel Limited and the other Covered Parties maintain no control over the personnel, equipment or operations of any airline or other Travel Supplier. Hutchison Travel Limited and the other Covered Parties do not guarantee or insure the services provided by any Travel Supplier of Travel Services and will not be responsible or liable for any act, error, omission, injury, loss, accident, damage, delay, non-performance, inconvenience, overbooking, irregularity or any consequences therefrom, which may be occasioned through the neglect or default, or any other action or inaction by any Travel Supplier.

You agree to abide by the terms and conditions imposed by any Travel Supplier from whom you decide to purchase Travel Services and you understand that failure to do so may result in cancellation of your reservation(s) and you being denied access to any flights or other Travel Service and/or required to cover any costs incurred by a Covered Party as a result of such violation. Hutchison Travel Limited and the other Covered Parties are not responsible for any such action by Travel Suppliers due to your failure to abide by such Travel Suppliers’ rules.

Neither  Hutchison Travel Limited nor the other Covered Parties, nor any provider of air traffic data makes any promises or guarantees as to the accuracy, completeness, or adequacy of any delay or other air traffic management information on the Program website or otherwise in connection with the Program, and expressly disclaims liability for any errors and omissions.

We recommend that you take out appropriate travel insurance in relation to your booking at the time you have made a booking with iGO Rewards™.

Electronic documents such as e-confirmations and e-documents will be provided to the email address given by the customer at the time of booking. Hutchison Travel Limited and the other Covered Parties are not responsible for any change in the contact information provided by the customer at the time of booking.

Travel Services Centre

The iGO Rewards™ Travel Services Centre will operate between 9am- 7pm HKT Monday –Saturday, closed on Sunday and Hong Kong/agreed public holidays. Cardholders may make amendments, changes & cancellations to their existing travel bookings via the Travel Services Centre. New travel reservations with payment of DBS$ or COMPASS dollar and Payment in cash only cannot be facilitated through the Travel Services Centre and can only be made through the Program website. Additional Travel Information and Terms

Terms and conditions applicable to the airline travel products, including packaged products

Limitation of liability

HTL in operating the Program acts as an agent for Travel Suppliers in selling travel services, or in accepting reservations or bookings for such services to be provided to you. HTL does not assume liability for any injury, damage, death, loss, accident or delay due to an act of negligence or the default of a Travel Supplier, or by an act of god. Further, no responsibility is accepted for any damage and/or delay due to sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather, fire, accidents, earthquakes, riots, strikes, wars, storms, acts of god or causes beyond HTL’s control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any government authority. The contract of carriage in use by a Travel Supplier, when issued, shall be between the Travel Supplier and the passenger.

Ticket restrictions

Airline tickets available through this Site are subject to the published conditions of carriage and rules of the applicable airline. Tickets may be purchased between 2 days and 330 days in advance. For tickets not originating from Hong Kong, they may be purchased between 3 days to 330 days in advance. Ticket restrictions and flexibility vary according to the type of fare purchased.

Fuel Surcharge Adjustment

The amount of fuel surcharge (if any) paid upon booking confirmation is an estimated cost only. Fuel surcharge is subject to adjustment (either increase or decrease) due to individual policies of airline companies. Hutchison Travel Limited will redeem extra amount paid by customer (if any), and at the same time, reserves the right to request customers to pay for the additional amount.

Use of ticket in Right Sequence and Changes in Itinerary

  1. Ticket is valid only for transportation shown on the itinerary from the place of departure through any agreed stopping places to the final place of destination.
  2. Ticket must be travelled in sequence. If customer do not show up for the scheduled flight without prior notice, all return or onward itinerary would be cancelled by airline automatically.
  3. The fare need to be recalculated when travel is changed. Changes such as reversing direction of travel, not travelling the first segment, departure date and flight number changes may result in fare increase. Customer is required to pay the fare difference and any additional taxes and surcharges or penalty fee. Customer can either accept the revised fare or maintain the original itinerary shown on the ticket.
  4. In case of travel change, customer is advised to inform iGO Rewards Travel Services Centre. iGO Rewards Program will assess the revised fare for the new itinerary. Otherwise, the unused portion of the ticket will not be valid anymore.

Please note that the terms and conditions for cancellation of bookings and purchases will vary for each product and service. Please therefore refer to the terms and conditions for a specific product or service or alternatively, check with our Travel Services Centre during office hours. Cancellation may be subject to cancellation fees which you agree to bear in full. Please note that cancellation after air tickets are issued is not permitted.

For bookings and purchases which have been pre-paid, refunds may be made at iGO Rewards Site’s sole discretion (subject to the refund policy). It may take an estimated 3 to 6 months before the credit appears in your account for air ticket refund processing. The preceding refund timeline is a guide for your reference only and shall not be binding upon iGO Rewards Program.

You agree to bear the full cost of any booking, cancellation and administration fees for any products or services booked but not utilized for any reason. In some cases, Hutchison Travel Limited may charge cancellation and/or amendment fees in addition to those imposed by travel service providers.

International Travel: Passports, Visas, Hazards and Disinsection

Travel to certain destinations may involve greater risk than others. Hutchison Travel Limited therefore urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the Hong Kong Government prior to booking tickets to international destinations. For The Outbound Travel Alert (OTA) System, please refer to https://www.sb.gov.hk/eng/ota/ . For foreign health requirements and dangers, please refer to https://www.travelhealth.gov.hk/eindex.html . At Hutchison Travel Limited, we shall not be responsible in providing information regarding foreign entry requirements (such as the need for passports and visas). For foreign entry requirements, please contact the consulates in Hong Kong.

Many countries require foreign nationals to hold a passport with at least 6 months validity (counting from the return travel date) when they enter these countries. Individual travellers and their companions are solely responsible for ensuring their travel documentation is valid. Passport, Visa (including any and all transit visas) and Health requirements are the responsibility of the individual travellers.

In view of the pandemic situation, a number of governments have issued entry restrictions, visa suspensions and quarantine measures for travellers. Recommended inoculations for travel may change at short notice and you should consult your doctor on current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication and follow all medical advice in relation to your trip. Travellers should refer to the latest information published by the government of their destination countries including countries you may  just be transiting through.

BY OFFERING OR FACILITATING TRAVEL TO PARTICULAR INTERNATIONAL DESTINATIONS, WE DO NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT ANY RISK, AND WE SHALL NOT BE LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

Travel Service Providers

You agree to abide by the terms or conditions of purchase imposed by any Travel Service Provider, whether that Travel Service Provider is selected by you or by Hutchison Travel Limited, including, but not limited to, payment of all amounts when due and compliance with the Travel Service Provider's rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of such Travel Service Provider's conditions of purchase may result in cancellation of your reservation(s) or purchase(s), in your being denied access to any flights, hotels, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase(s), and in iGO Rewards Site debiting your account for any costs Hutchison Travel Limited incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Site.

You agree that we will not be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with the performance or non-performance of any Travel Service Provider, including, but not limited to, non-performance resulting from bankruptcy, reorganization, insolvency, dissolution or liquidation, even if we have been advised of the possibility of any such damages. In the event of non-performance resulting from bankruptcy, reorganization, insolvency, dissolution or liquidation of a Travel Service Provider, you agree that your sole recourse shall be toward such Travel Service Provider and not toward us.

At iGO Rewards Program, we shall not be responsible for information regarding the suitability for disabled persons of any portion of any tour or other reservation. For information concerning the suitability for disabled persons for any portion of any tour or other reservation, please contact the Travel Service Supplier directly.

Airline Rules, Itinerary Changes and Price Changes: Airline tickets available through this Site are subject to the published conditions of carriage and rules, including but not limited to cancellation policies, of the applicable airline. The contract of carriage in use by the applicable airline, when issued, shall be between the applicable airline and the passenger. Airlines retain the right to adjust flight times and schedules at any time - schedule changes can result in an itinerary that falls outside of contractual agreements. Airlines may also in their discretion change or cancel flights or itineraries. Airlines provide us with the price and other information related to these services. Hutchison Travel Limited endeavors to publish and maintain accurate prices and information for its airline services. In the event, however, that a service is listed or provided to us at an incorrect price or with incorrect information due to typographical error or other error in pricing or service information received from an airline, Hutchison Travel Limited and/or the airline retain the right to refuse or cancel any Requests placed for such service, whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your Request is canceled because of incorrect airline information, Hutchison Travel Limited and/or the airline will promptly issue a credit to your credit card account in the amount of the charge. In the event that an airline publishes a fare at one price and later determines not to honor that fare at that price, Hutchison Travel Limited is not responsible for and cannot honor the price that was originally listed by the airline. Only the airline can determine whether or not to honor the mis-stated price.

Age Requirements

For published price airline tickets, you may make an airline reservation for children age 15 or older to fly without an adult (18 or older) accompanying them. For children under the age of 15, at least one adult passenger aged 18 or older must accompany the child(ren) on the same reservation. For infant tickets, please ensure to abide by the airline’s condition of carriage as infant seating, baby bassinets and baby car seats may be subject to restrictions.

Code Share

Some airlines enter into "code share" agreements with a limited number of select airline partners. This means that on certain routes, the airline carrier selling or marketing the flight does not fly its own aircraft to that destination. Instead, it contracts with a partner airline to fly to that destination. The partner airline is listed as "operated by." In most cases you will check in with your "operating" carrier; however, you should verify your flight check-in location with your ticketing carrier. If your flight is a code share, it will be disclosed to you in the booking process and prior to your payment on a price disclosed, retail airline ticket.

Airline Prohibited Practices

You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a "point-beyond", "hidden-city", or "back-to-back tickets" if those practices are prohibited by the airline(s). You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel if that practice is prohibited by the airline(s). You acknowledge that most airlines prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets if you engage in these practices. You agree to indemnify the Covered Parties against airline claims, on the basis of these or any other prohibited practices, for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

Baggage and Other Ancillary Airline Fees: The airlines may require you to pay additional fees at the airport for certain services and/ or if you exceed certain limits as dictated by the airline, such as the number of bags or weight allowed, and some airlines do not offer a free baggage allowance.

Entry/Exit Fees

If you are traveling internationally, some countries or airports charge fees upon entering and/or exiting the country. These fees are not included in the ticket price, or the taxes and fees we display on our website prior to purchase.

Terms and conditions applicable to the hotel booking, including packaged products

  1. General Hotel Service Restrictions

    1. Check In:

      Upon check-in, guests must present a valid ID and credit card or, in the hotel's discretion, debit card, in their name that is consistent with the transactional details provided to iGO Rewards Site (the amount of available credit required will vary by hotel). Please note that debit cards may not be accepted.

    2. Late Arrival and Failure to Check-in on First Night:

      While you should call iGO Rewards Travel Services Centre if you wish to cancel a cancellable reservation in advance of your stay, if you are going to be delayed on your date of check-in or find that you cannot check in to your hotel on the date you requested, you should contact the hotel to let them know. If you fail to check in to your hotel on the day of your reservation and do not alert the hotel, the remaining portion of your reservation may be canceled and you may not be entitled to a refund, depending on the terms and conditions of the applicable hotel.

    3. Cancellations and Changes to Your Reservation:

      Hotel cancellation policies vary. Certain reservations are non-cancellable and non-changeable. Others require you to pay a penalty if you cancel. Still others are fully refundable. Check the hotel cancellation policy when you book. Amendment is not allowed on all hotel reservation once confirmed.

    4. Disability Needs

      If you have disability needs (for example only, you need a wheelchair accessible room or require the use of a service animal) you must call the hotel and verify that disability needs can be met. If your disability needs cannot be accommodated by the hotel, please contact Travel Services Centre.

    5. Hotel Accommodations and Special Requests

      Depending upon which iGO Rewards hotel reservation service you use, you may or may not be able to select your room type and number and/or type of beds. Room assignments are based on hotel availability and are at the hotel's discretion. We cannot guarantee a non-smoking room. If you have special requests (including, for example, preferences for smoking or non-smoking rooms, a specific room, particular bedding, floor location, closeness to an elevator, connecting rooms, or pet accommodations), you must call the hotel and verify that special requests can be met after you have made your booking. Since iGO Rewards Program has no control over which room a hotel will assign to you, iGO Rewards Program cannot accommodate special requests in advance of your booking and cannot guarantee that special requests will be met.

    6. Must be 18 Years of Age

      The guest on the reservation must be 18 years of age or older to check into the hotel.

    7. Hotel Star Ratings (General)

      iGO Rewards’ star rating system is provided for your reference. Like other well-known hotel rating systems, to assign a single star rating, iGO Rewards Program considers a number of factors in evaluating the quality of participating hotels, such as amenities, facilities, reputation, brand, other rating services, customer feedback from guests who have stayed at the hotel, etc.. iGO Rewards Program screens participating hotels carefully and updates our information periodically to ensure the validity of our ratings. Our ratings systems may sometimes differ from those of other rating systems that you may be familiar with. We do not warrant or guarantee that our star rating system is equal to or consistent with any other star rating system and reserve the right to change a hotel's rating at any time with or without notice.

    8. Prices

      Sometimes cheaper rates are available for a specific stay at a hotel, however, these rates made by hotels may carry special restrictions and conditions, for example in respect of cancellation and refund. Please check the room and rate details thoroughly for any such conditions prior to making your reservation. We reserve the right for marketing and commercial reasons to modify prices.

    9. Pricing Errors

      Hutchison Travel Limited endeavors to publish and maintain accurate prices and information for the services we offer. Hotels provide us with the price and other information related to these services.

      In the event, however, that a service is listed or provided to us at an incorrect price or with incorrect information due to incorrect service information received from hotels, typographical error or system error or other error in pricing, we retain the right to refuse or cancel any orders placed for such service.

      We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your order is canceled because of incorrect supplier information, we will promptly issue a credit to your credit card account in the amount of the charge. Prices, rates and inventory are subject to availability from the hotels.

    10. Reservation

      You may not book reservations for more than 8 rooms online for the same hotel/stay dates. If we determine that you have booked reservations for more than 8 rooms in total in separate reservations, we may cancel your reservations, and charge you a cancellation fee, if applicable. If you paid a non-refundable deposit, your deposit will be forfeited.

  2. Merchant Price Disclosed Hotel Service

    iGO Rewards Site's Merchant Price Disclosed Hotel Service is a hotel service whereby the price of the hotel is disclosed to the User in advance of booking and whereby iGO Rewards Program acts as the merchant of record on the transaction (i.e., directly charges your credit or debit card and not the hotel).

    Hotel bookings made available through iGO Rewards Site's Merchant Price Disclosed Hotel Service are subject to the disclosed terms and conditions on your contract page and the disclosed terms and conditions of the applicable hotel you select.

    The "Total Charges" that you will pay for using our Merchant Price Disclosed Hotel Service will always be disclosed to you before you submit your Request.

    1. Charges for Taxes and Fees

      In connection with facilitating a Merchant Price Disclosed Hotel transaction, we will charge your method of payment for Taxes and Fees. This charge includes an anticipated amount to recover the amount we pay to the hotel in connection with your reservation for taxes owed by the hotel including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value added tax and/or other similar taxes. In certain locations, the tax amount may also include government imposed service fees or other fees not paid directly to the taxing authorities but required by law to be collected by the hotel. The amount paid to the hotel in connection with your reservation for taxes may vary from the amount we anticipate and include in the charge to you. The balance of the charge for Taxes and Fees is a fee we retain as part of the compensation for our services and to cover the costs of your reservation, including, for example, customer service costs. The charge for Taxes and Fees varies based on a number of factors including, without limitation, the amount we pay the hotel and the location of the hotel where you will be staying, and may include profit that we retain.

      We are not the vendor collecting and remitting taxes to the applicable taxing authorities. Our hotel suppliers, as vendors, bill all applicable taxes to us and we pay over such amounts directly to the vendors. We are not a co-vendor associated with the vendor with whom we book or reserve our customer's travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location.

      For transactions involving Merchant Price Disclosed Hotels located within certain jurisdictions, the charge to your debit or credit card for Taxes and Fees includes an additional payment of tax that we are required to collect and remit to the jurisdiction for tax owed on amounts we retain as compensation for our services.

Payment

Program website: To make a new reservation, full payment using (i) DBS$ or COMPASS Dollar only, (ii) combination of DBS$ and Cash or COMPASS Dollar and Cash (in Hong Kong Dollars), or (iii) Cash (in Hong Kong Dollars) only) is required, in each case plus a mandatory Booking Administration Fee of HKD50 should be paid. Payment is due in full at the time of confirmation and will be facilitated through the Program website. All cash components of payment must be made using an Applicable Credit Card that is related to the logged in account only. Should an error occur in processing your Applicable Credit Card for applicable charges, Hutchison Travel Limited reserves the right to resubmit the charge to DBS. Hutchison Travel Limited also reserves the right to re-invoice your reservation should an error be made in computing your reservation price. Rates are subject to change, including, but not limited to, as a result of increases in or establishment of surcharges, applicable taxes or government fees, and changes in airfare and hotel prices. Only new reservations shall be permitted through the Program website. Amendments, changes & cancellations of existing travel reservations must be made through the Travel Services Centre.

Travel Services Centre: No new reservations with DBS$ or COMPASS Dollar or in Cash (Hong Kong Dollars) can be made through the Travel Services Centre. Only amendments, changes & cancellations of existing travel reservations are permitted through the Travel Services Centre. Additional change fees incurred in connection with an amendment, change or cancellation must be paid using an Applicable Credit Card. Redemption of DBS$ or COMPASS Dollar is not permitted for amendments / changes and cancellations. Payment is due in full at the time of confirmation and will be facilitated through the Travel Services Centre.

Amendments & Cancellations

A “Cancellation” is defined as complete change made to the name of a traveler when booked (complete name change), the substitution of one traveler in place of another, a reduction to the number in the travelers within the existing reservation, reduction of a portion of the existing reservation, and/or the termination of the entire trip. Changing the date of departure or return date is also classified as a Cancellation. All other changes are defined as Amendments. No Amendments and Cancellations are permitted through the Program website. Amendment and Cancellation requests can only be made through the Travel Services Centre.

Amendment and Cancellation Fees: Amendments and Cancellations are subject to Terms and Conditions set out here or otherwise disclosed at the time of booking. In certain circumstances, Amendments & Cancellations may not be possible. If Amendments and Cancellations are possible, one or more of the following fees components will be applicable in the particular order below:

Travel Suppliers’ Amendment and Cancellation Fees applicable as part of the Amendment or Cancellation,

Program Amendment and Cancellation Fees of HKD 275 per Amendment or Cancellation,

Additional Program service fees and charges: All such charges will be in addition to any Travel Supplier charges and are subject to change at any time.

In the event of an amendment or cancellation requested by Cardholder, the DBS$ or COMPASS Dollar component collected in the original booking will be used to first offset any Travel Suppliers’ Amendment and Cancellation Fees. If the DBS$ or COMPASS Dollar component is insufficient, the HKD component of the original booking will be used to offset the excess Travel Suppliers’ Amendment and Cancellation Fees. The remaining DBS$ or COMPASS Dollar, or HKD component of the original booking can then be used to offset the Program Amendment and Cancellation Fees plus any additional program service fees and charges, using a 1:1 HKD to DBS$ or COMPASS Dollar conversion ratio.

Refund: In the event that a full or partial refund is due to Cardholder on a Cancellation or Amendment requested by Cardholder, the DBS$ or COMPASS Dollar that were used for the booking will be held on the Cardholder’s file as a Credit and cannot be refunded. A Credit will be held for 12 months, from the date of cancellation, may only be used for one new Travel Service booking during that 12 month period, and is otherwise strictly non-refundable and non- extendable. Terms and Conditions for Credits may vary by booking and will be further disclosed during the Amendment and Cancellation process undertaken via the Travel Services Centre. The cash component will be refunded to the Applicable Credit Card that was used for the booking, less any applicable Amendment and Cancellation Fees.

Responsibilities and Liability

Customer Responsibilities: You are responsible for examining and verifying all information provided by or to you in connection with a Travel Service enquiry or booking, and for ensuring that you understand all of the policies, fees and requirements to which your enquiry or booking is subject. You are responsible for confirming and adhering to any recommended pre-departure check in timing and presentation at gate timing. Failure to comply with these conditions may result in the loss of your Travel Service. Your rights and remedies set forth herein are in addition to any other rights and remedies under applicable law, but if a refund is available and you accept it, you waive all other remedies. Unless you file any claim you may have with us within 30 days after the conclusion of your Travel Service, all parties are released from further liability.

IN NO EVENT SHALL HUTCHISON TRAVEL LIMITED OR ANY OTHER COVERED PARTIES BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS PROGRAM WEBSITE, THESE TERMS AND CONDITIONS, THE PURCHASE OF, OR REDEMPTION OF ANY POINTS FOR, TRAVEL SERVICES, THE USE OR CONSUMPTION OF THE TRAVEL SERVICES, EVEN IF A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Further, except as set forth below, Hutchison Travel Limited and the other Covered Parties accept no responsibility for any damage and/or delay due to any Travel Supplier cancellations, shortages, sickness, pilferage, labor disputes, bankruptcy, machinery breakdown, quarantine, government restraints, weather, terrorism or causes beyond the Covered Parties' control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Parties shall be responsible for any Travel Supplier’s breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Parties be responsible for any other wrongdoing of a Travel Supplier (including any liability in tort), as to any Travel Services. Neither Hutchison Travel Limited nor any other Covered Party shall be responsible for any Travel Supplier’s failure to comply with these Terms and Conditions, nor for any Travel Supplier’s failure to comply with applicable federal, state, provincial and local law. If, notwithstanding the above, Hutchison Travel Limited or any other Covered Party is found liable for any loss or damage relating to the Program, you agree the liability of any such party shall in no event exceed the amount of HKD100. To the extent such limitation of liability is contrary to applicable law, it might not apply to you.

Hutchison Travel Limited Responsibilities: As the licensed travel agent for the Travel Services, Hutchison Travel Limited is responsible to you for making the applicable arrangements for Travel Services being booked under the Program. The responsibility of Hutchison Travel Limited and the other Covered Parties does not extend to any liability for personal injury or property damage arising out of or caused by any negligent act or omission on the part of any Travel Supplier or any other person involved in the Travel Services. Neither Hutchison Travel Limited nor any other Covered Party is responsible for: (i) any changes made by scheduled air carriers which are beyond our control (this includes, but is not limited to, routing changes, aircraft equipment changes, flight cancellations or any changes to flight schedule); or (ii) damage, delay or vacations affected by weather or other force majeure events beyond our control. In no event shall any Covered Party be liable for consequential damages. We reserve the right to substitute hotel accommodations, if necessary, due to circumstances beyond our control. Special requests such as room location, special meals or assistance will be communicated to the appropriate party, but cannot be guaranteed. Specials may be withdrawn at any time. Rates are based on availability.

Important Notice: Neither  Hutchison Travel Limited nor any of their affiliates and their employees, officers, directors and shareholders (i) owns, controls or operates any Travel Service business in their own right, (ii) are responsible for any negligent or willful act, omission or failure to act on the part of any Travel Supplier, or of any other third party beyond their control. Hutchison Travel Limited acts only as an agent for the Cardholder in regards to Travel Services, and assumes no liability for injury, damage, loss, accident, delay or irregularity which may be caused due to a defect in any vehicle, acts of God, war, riots, or by any company or person involved in the Travel Services.

Hutchison Travel Limited reserves the right to make minor adjustments in the Cardholder’s travel itinerary and to cancel any trip prior to departure. In the event of trip cancellation, a full refund will constitute a full settlement of all liability. The issuance of vouchers or tickets shall be deemed to be your consent to the above terms. The Cardholder’s ticket(s), when issued, shall constitute the sole contract between the applicable Travel Supplier and the Cardholder, and  Hutchison Travel Limited shall have no liability for any actions or omissions of the Travel Supplier. In addition, Hutchison Travel Limited shall have no responsibility for any credit or voucher issued by any Travel Supplier, and any questions or issues you may have with respect to such credit or voucher must be addressed directly with the Travel Supplier.

All rates published are based on exchange rates and tariffs and are subject to change. All taxes, gratuities and porterage charges are subject to deletions, additions or changes without notice. These items are not under the control of Hutchison Travel Limited. Hutchison Travel Limited is not responsible for any changes initiated by the Cardholder after departure.

THE INFORMATION PUBLISHED ON THIS PROGRAM WEBSITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. HUTCHISON TRAVEL LIMITED DOES NOT GUARANTEE THE ACCURACY OF, OR RELATING TO, THE INFORMATION AND DESCRIPTIONS ON THIS PROGRAM WEBSITE, INCLUDING BUT NOT LIMITED TO INFORMATION AND DESCRIPTIONS OF THE HOTEL, AIR, CRUISE, CAR AND OTHER TRAVEL SERVICES DISPLAYED (INCLUDING, WITHOUT LIMITATION, PHOTOGRAPHS, LIST OF HOTEL AMENITIES, GENERAL PRODUCT DESCRIPTIONS, ETC). THE COVERED PARTIES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION AND TRAVEL SERVICES DISPLAYED ON OR OFFERED VIA THIS PROGRAM WEBSITE FOR ANY PURPOSE, AND THE INCLUSION OF ANY TRAVEL SERVICES ON THIS PROGRAM WEBSITE DOES NOT CONSTITUTE ANY ENDORSEMENT OR RECOMMENDATION OF SUCH TRAVEL SERVICES BY ANY COVERED PARTY. ALL SUCH INFORMATION AND TRAVEL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COVERED PARTIES DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION AND THE TRAVEL SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NEITHER HUTCHISON TRAVEL LIMITED, NOR ANY OF THEIR RESPECTIVE AFFILIATES ARE LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY TRAVEL SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES OCCURRING OR ARISING IN CONNECTION WITH THE TRAVEL SERVICES.

HUTCHISON TRAVEL LIMITED HAS NO LIABILITY AND (SUBJECT TO THESE TERMS) WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE OR OTHER CAUSE BEYOND ITS DIRECT CONTROL, AND IT SHALL HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR ACTS OF ANY GOVERNMENT OR OTHER AUTHORITY.

Nothing in these Terms and Conditions seeks to exclude or limit liability which may not be excluded or limited under applicable law.

You agree to indemnify, defend and hold Hutchison Travel Limited and the other Covered Parties harmless from any liability, loss, claim and expense, including reasonable attorneys' fees and expenses, related to your breach of these Terms and Conditions. This indemnity extends to any breach of these Terms and Conditions by any person on behalf of whom you made, or sought to make, your booking.

Miscellaneous

These Terms and Conditions constitute the entire agreement and understanding between you and us with respect to the subject matter hereof and supersede and cancel in all respects all prior agreements and understandings with respect to the same subject matter, whether such be written or oral.

The invalidity, illegality or unenforceability of any provision of these Terms and Conditions shall not affect the validity, legality and enforceability of any other provisions of these Terms and Conditions. Our failure or delay to enforce any of our rights or any provision of these Terms and Conditions at any time shall not be deemed to be a waiver of such right or of any other similar or dissimilar provision.

You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong and you agree to submit to the exclusive jurisdiction of the courts of Hong Kong.

 Hutchison Travel Limited, of Unit 1203, 12/F, Two Harbourfront, 22 Tak Fung Street, Hung Hom, Hong Kong, is the holder of a travel agency license (number 351033) issued under the Hong Kong Travel Agents Ordinance, and in making the Travel Services available to you and facilitating your bookings in accordance with these Terms and Conditions, acts only as an agent.
